1. Acceptance of the Terms
This agreement sets out the general Terms and Conditions that govern access to, browsing of, and use of the website and the services offered by TENMA CONTROL, a digital platform that provides digital marketing services, bulk messaging, website development, mobile applications, and corporate branding. By accessing or using our website, you expressly and unreservedly agree to be bound by these Terms and Conditions.
2. Legal capacity
By using this site, you represent and warrant that you are at least 18 years of age and have legal capacity to enter into binding contracts under applicable law.
3. Nature of the services
All services offered by TENMA CONTROL are digital in nature. Products and services are delivered exclusively by electronic means and may be purchased through a one-time purchase or a recurring subscription.
4. Registration and accuracy of information
You represent that all information you provide to TENMA CONTROL is true, accurate, and up to date. We reserve the right to suspend or cancel services for users who provide false or misleading information.
5. Payments, subscriptions, and cancellations
5.1. Subscriptions are billed monthly on a fixed charge date.
5.2. No refunds or returns are granted once payment has been made.
5.3. The customer may cancel a subscription at any time. Cancellation takes effect at the end of the paid period.
5.4. TENMA CONTROL reserves the right to change prices, terms, or service features, with at least 7 days’ prior notice.
6. Use restrictions
You agree not to use the services for unlawful purposes, attempt unauthorized access to TENMA CONTROL systems, compromise the security of the site, or use automated tools that alter its operation.
7. Intellectual property
All site content, including designs, logos, text, images, source code, trade names, and trademarks, is protected. Use, reproduction, distribution, or modification without TENMA CONTROL’s express written authorization is prohibited.
8. Confidentiality
Any information you provide to TENMA CONTROL that is not in the public domain will be treated as confidential and will not be shared with third parties without consent, except where legally required.
9. Digital security and disclaimer
TENMA CONTROL implements reasonable digital security measures; however, it does not guarantee that the site is free of errors, viruses, or attacks. Use of the site is at the user’s own risk.
10. Links to third-party sites
This site may contain links to third-party websites. TENMA CONTROL has no control over those sites and is not responsible for their content, policies, or availability.
11. Modifications
We reserve the right to modify these Terms and Conditions. Changes will be communicated by email and/or text message. Continued use of the site constitutes acceptance of the updated terms.
12. Governing law and jurisdiction
This agreement is governed by the laws of the State of Baja California, Mexico. Any dispute will be resolved before the competent courts of the city of Tijuana, Baja California.
13. Alternative dispute resolution
The parties may choose mediation or arbitration under applicable Mexican law before resorting to court litigation.
